The bill allows account holders to nominate four people instead of one, which will simplify fund disbursement to families and reduce procedural delays. The Bill makes amendments to cooperative banks . It extends the term of office of directors (except the chairman and whole-time directors) from eight years to ten years , as envisaged in the Constitution (97th Amendment) Act, 2011. The amendment will allow a director of a central cooperative bank to serve on the board of a state cooperative bank, which could promote leadership stability in such banks.
Another significant change is the revision of regulatory reporting dates for banks . Banks will now be required to submit regulatory compliance reports on the 15th and last Fridays of each month, instead of the second and fourth Fridays of the month. This revision aims to improve consistency in financial regulation. The bill provides greater autonomy to banks in deciding the remuneration of statutory auditors, which is likely to promote flexibility in financial regulation.
A significant amendment redefines the term "substantial interest" held by a person in a bank . "Substantial interest" generally refers to a significant financial stake or ownership stake in a business; it is typically defined as ownership of shares worth more than five lakh rupees or 10 percent of the company's paid-up capital, whichever is less.
It can be held individually or collectively by an individual, their spouse, or a minor child. The bill amends this limit to increase it to ₹2 crore. The Act empowers the central government to make rules on several matters. These include: (i) regulating the granting of leases, (ii) the terms and conditions of leases, including the minimum and maximum area and lease period, (iii) the conservation and development of mineral oils, (iv) the methods of oil production, and (v) the manner of collection of royalties, fees, and taxes. The bill retains these provisions.
The Bill states that the central government may also make rules on: (i) merger and combination of petroleum leases, (ii) sharing of production and processing facilities, (iii) obligations of lessees to protect the environment and reduce emissions, (iv) alternative mechanisms for resolving disputes in relation to grant of petroleum leases. The Act provides that violations of the rules are punishable with imprisonment of up to six months, a fine of ₹1,000, or both. The bill also includes the following offenses: (i) carrying out activities related to mineral oils, such as exploration, prospecting, and production, without a valid lease, and (ii) non-payment of royalties.
